Terms and conditions of use
By Purchasing a Class or Workshop, held at the Stable Hands Pottery Studio you agree to the following:
Rule 1
In consideration of the risk of injury while participating in use of the Pottery Studio (The Activity), and as consideration for the right to participate in the Activity, You hereby, for yourself, your heirs, executors, administrators, assigns, or personal representatives (the “participant”), knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of your participation in the Activity, and do hereby release and forever discharge Stable Hands Pottery, located at Honey Field Farm, 6217 Ross Road, Abbotsford, BC, V4X 1Z1, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns (the “Host”), for any and all physical or psychological injury now or in the future, including but not limited to injury, illness, paralysis, death, damages, economical or emotional loss, that You may suffer as a direct result of your participation in the aforementioned Activity.
Rule 2:
You acknowledge that this activity may involve a test of a person’s physical and mental limits, and may carry with it the potential for injury (possibly serious) both short term, and long term, death, and property loss.
a. The risks may include, but are not limited to, those caused by exposure to dust or chemicals, facilities, temperature, wet floors, equipment failure or misuse, condition of participants, equipment malfunction, actions of others, including but not limited to, participants, volunteers, spectators, instructors, visitors, landlord(s).
Rule 3:
You are aware that there are inherent dangers, hazards and risks (collectively “risks”) associated with being on a farm and injuries resulting from these “risks” are a common occurrence. You are aware that the “risks” mean those dangerous conditions which are an integral part of farm activities, including but not limited to:
a. The propensity of any animal to behave in ways that may result in injury, harm or death to persons on or around them and to potentially collide with, bite or kick other animals, people or objects;
b. The unpredictability of an animal’s reaction to such things as sounds, sudden movement, tremors, vibrations, unfamiliar objects, persons or other animals and hazards such as sub-surface objects;
c. The potential for other participants to behave in a negligent manner that may contribute to injury to themselves of others, including failing to act within their abilities to maintain control over an animal.
d. The “risk” associated with the movement of farm machinery and equipment around and through the barn area without notice. Including but not limited to, tractor, gator utility vehicle, wheelbarrows, rakes, posts, equine paraphernalia.
Rule 4:
You agree that although the “Host” has taken steps to reduce the “risks” and increased the safety of the studio environment, it is not possible for the “Host” to make the barn completely safe. You accept these “risks” and agree to the terms of this waiver, even if the “Host” is found to be negligent or in breach of any duty of care, or any obligation to me in your participation in pottery studio activities.
Rule 5:
You confirm that You have sufficient time to read and understand this waiver in its entirety. You understand that this agreement represents the entire agreement between myself and the “Host”, and it is binding on myself and your “legal representatives”. You expressly agree to release and discharge the “Host” from any and all claims or causes of action and You agree to voluntarily give up or waive any right that You otherwise have to bring a legal action against the “Host” for personal injury of property damage. In the event that any damage to equipment or facilities occurs as a result of your or your family's willful actions, neglect or recklessness, You acknowledge and agree to be held liable for any and all costs associated with any actions of neglect or recklessness.
Rule 6:
Class tuition refunds will only be issued if the student submits cancellation in writing at least 5 days in advance of the class start. On-line processing fees are not refundable. Registration fees may be transferrable to future classes at the discretion of the Studio management.
